Families of the Children of John4 Washburn (3rd) and his wives Hannah Hallett and Hannah Thorneycraft

 

 

            Most of the children of John Washburn (3rd) and his wives Hannah Hallett and Hannah Thorneycraft that I am able to trace settled in Westchester County, New York, for several generations, a few moving north to Dutchess County. Son Samuel remained in Newtown, Long Island, but no descendants of his are traced at this point. These families are an ongoing work in progress, many are incomplete, and I will be add to this file as new information is uncovered.

Samuel5 Washburn, possibly second son of (276) John4 Washburn (3rd), (89) John3 (Jr.), (49) John2, (30) William1; born in Hempstead, Long Island, NY, in ca. 1709, baptized in Jan. 1729/30 in the Episcopal Church in Newtown, Queens Co., NY,[1] married Abigail4 Moore, daughter of Joseph3 and Elizabeth (Sackett) Moore, of Newtown, Long Island,[2] in say ca. 1736. She was born on 10 Nov. 1715 in Newtown, NY,[3] a granddaughter of Samuel2 and Mary (Reed) Moore, of Newtown.[4] The will of Joseph Moore, dated 11 June 1753, and probated on 14 Aug. 1756 in New York City, mentioned his daughter Abigail Washburn, and grandchildren Elizabeth Washburn and Hannah Washburn.[5] (See Appendix [A] for a full transcription of the Will of Joseph Moore of Newtown.)

         Samuel Washburn lived in Newtown, Long Island, where he was a weaver.[6] He died on 8 June 1768 in Newtown, Queens Co., NY,[7] but no probate records were filed for his estate in New York.

         Samuel Washburn and Abigail Moore had children:

        2239     i   Elizabeth Washburn, mentioned in the 1753 will of her grandfather, Joseph Moore, died unmarried in 1761.[8]

        2240    ii   Hannah6 Washburn, born on 22 Feb. 1747, mentioned in the 1753 will of her grandfather, Joseph Moore, married Richard Hallett, of Newtown, as his second wife, on 20 Dec. 1767 in the Presbyterian Church in Newtown, Queens Co., NY.[9] He had married first to Elisabeth Titus on 24 Dec. 1759 in Newtown.[10] Children not found.

 

 

(851.) Isaac5 Washburn, possibly third son of (276) John4 Washburn (3rd), (89) John3 (Jr.), (49) John2, (30) William1; born in Westchester Co., NY, on 26 Dec. 1712,[11] married 1.) Mehitabel (___) in ca. 1740. She was born in 1715, and died “the last of February 1760.”[12] He remarried to 2.) Hannah Lovejoy on 20 July 1760,[13] probably in Westchester Co., NY. She was born on 9 Nov. 1724, and died on 5 July 1768.[14] He remarried again to 3.) Mary Moore in July 1770.[15] She was born on 18 Aug. 1733.[16]

         Isaac Washburn owned property in Westchester Co., NY, next to his brother, Joseph Washburn. He was a Loyalist during the Revolutionary War, and was arrested as a spy.[17] He was not a head of household in Westchester Co., NY, in the 1790 or 1800 federal censuses, but he supposedly died in 1800 in North Castle, Westchester Co., NY.[18] No probate records were filed for his estate in Westchester Co., NY.

         Isaac Washburn had 8 children by Mehitabel, one daughter by Hannah Lovejoy, and 5 more children by Mary Moore:[19]

        2243    ii   Martha Washburn, born on 16 Oct. 1742 in Westchester Co., NY.[21]

        2245   iv   Charity Washburn, born on 11 May 1747 in Westchester Co., NY.[23]

        2246    v   Libbe Washburn, born on 1 Oct. 1750 in Westchester Co., NY.[24]

+      2247   vi   Isaac6 Washburn (Jr.), born on 7 Apr. 1752 in Westchester Co., NY,[25] married Sarah “Sally” Purdy,[26] supposedly daughter of Stephen and Hester (Bailey) Purdy,[27] in ca. 1783.[28] (To be continued in Washburn Generation 6.)

        2249 viii   Zephaniah Washburn, born on 10 Dec. 1759 in Westchester Co., NY.[31] He was not a head of household in the 1790 or 1800 federal censuses in New York.

        2253  xii   Reuben6 Washburn, born on 12 June 1775 in Westchester Co., NY,[36] supposedly married Rebecca Scott.[37] She was born ca. 1775, and died on 30 June 1850 in Dutchess Co., NY.[38] He died on 23 June 1850 in Dutchess Co., NY.[39] Children not found.

        2255 xiv   Wellington Washburn, born on 30 May 1780 in Westchester Co., NY,[41] died in 1780.[42]

 

 

(852.) Joseph5 Washburn, possibly fourth son of (276) John4 Washburn (3rd), (89) John3 (Jr.), (49) John2, (30) William1; born in Flushing or Hempstead, Long Island, NY, on 11 Oct. 1713,[43] mar­ried Rosannah Dickinson, daughter of Joseph and Hannah (Carpenter) Dickinson (Jr.),[44] in ca. 1746.[45] She was born supposedly on 10 Sept. 1724,[46] a granddaughter of Joseph and Rose (Townsend) Dickinson, and of Nathaniel and Tamar (Coles) Carpenter. They moved to Westchester Co., NY, and he was a witness in Westchester Co., NY, in 1747.[47] He was probably the Joseph Washburn, Sr., living in Westchester Co., NY, in the 1790 federal census.[48]

         Joseph Worshburn died testate in Oct. 1793 in North Castle, Westchester Co., NY,[49] his will dated 29 July 1788, and probated on 28 May 1794, mentioned his wife Roesanah Worshburn, his sons James Worshburn and Joseph Worshburn, who was under 21, and daughters Hannah, Phebe, Anna, Susanah, Deborah, Mercy and Sarah, and he named his wife Roseanah, and sons James Worshburn and Joseph Worshburn as executors of his estate.[50] (See Appendix [B] for a full transcription of his will. Rosannah (Dickinson) Washburn died on 2 July 1793 in Chappaqua, Westchester Co., NY.[51]

         Joseph Washburn and Rosannah Dickinson had children:

        2257    ii   Phebe6 Washburn, born on 11 May 1749, mentioned in the 1788 will of her father, supposedly died on 26 Jan. 1817,[53] presum­ably unmar­ried, but no probate records were filed for her estate in Westchester Co., NY.

        2258   iii   Deborah Washburn, born on 17 Apr. 1751,[54] mentioned in the 1788 will of her father, marriage not found.

+      2259   iv   Susannah6 Washburn, born on 12 Mar. 1754 in North Castle, Westchester Co., NY,[55] mentioned in the 1788 will of her father, married William Townsend, son of Silvanus and Abigail (Buckbee) Townsend,[56] in 1775 in North Castle, Westchester Co., NY.[57] (To be continued in Washburn Generation 6.)

        2260    v   Robert Washburn, born on 8 Feb. 1756,[58] died on 19 Oct. 1777,[59] presumably unmarried, not mentioned in his father’s will.

        2261   vi   Anne6 Washburn, born on 16 Oct. 1758,[60] mentioned in the 1788 will of her father, died supposedly on 18 July 1833,[61] but no probate records were filed for her estate in Westchester Co., NY.

        2262  vii   Mercy6 Washburn, born on 16 Sept. 1760,[62] mentioned in the 1788 will of her father, died supposedly on 20 Nov. 1839,[63] but no probate records were filed for her estate in Westchester Co., NY.

+      2263 viii   Sarah6 Washburn, born on 19 July 1763,[64] mentioned in the 1788 will of her father, married Charles White in say ca. 1788,[65] and they moved to Seneca Co., NY. (To be continued in Washburn Generation 6.)

+      2264   ix   James6 Washburn, born on 18 Feb. 1766 in North Castle, Westchester Co., NY,[66] mentioned in the 1788 will of his father, married Judith/Juda Griffin, daughter of Gershom and Phoebe Griffin,[67] on 24 Dec. 1788 in North Castle, NY.[68] (To be continued in Washburn Generation 6.)

+      2265    x   Joseph6 Washburn (Jr.), born on 28 Apr. 1770 in North Castle, Westchester Co., NY,[69] mentioned in the 1788 will of his father, married Philena Car­pen­ter in 1790, and they moved to Ulster Co., NY, then to Ohio in 1820. (To be continued in Washburn Generation 6.)

 

 

(855.) Richard5 Washburn, possibly sixth son of (276) John4 Washburn (3rd), (89) John3 (Jr.), (49) John2, (30) William1; born probably in Hempstead, Long Island, NY, on 27 June 1720,[70] mar­ried Amy Birdsall, daughter of Daniel and Johannah (Hawxhurst) Birdsall, in 1748,[71] and they lived in North Castle, Westchester Co., NY. She was born on 4 Mar. 1732 in Oyster Bay, Queens Co., NY,[72] a granddaughter of Samuel Birdsall, and of Samson and Hannah (Townsend) Hawxhurst, of Oyster Bay. The will of Samson Hawxhurst, of Oyster Bay, dated 23 Oct. 1732, and probated on 21 Nov. 1732, mentioned his daughter Jehannah, wife of Daniel Burdsell, and her three children Sarah Burdsell, Mary Hannah Burdsell, and Amy Burdsell, among others.[73] (See Appendix [C] for a full transcription of the will of Samson Hawxhurst.) Richard Washburn recorded his earmark in North Castle on 21 Mar. 1745.[74]

         Richard Washburn died testate on 10 Mar. 1786 in North Castle, Westchester Co., NY, and was buried in Chappaqua Cemetery, Chappaqua, Westchester Co., NY.[75] His will was dated 4 Mar. 1775, and probated on 5 June 1786,[76] and he mentioned his wife Amy, sons Joseph, Daniel, William, John, Samuel, Jesse, and Richard, and daughters Philena and Amy. It was witnessed by Stephen Sands, John Ireland, and Samuel Moore.[77] (See Appendix [D] for a full transcription of his will.)

         Amy (Birdsall) Washburn died testate on 16 Oct. 1812 in New Castle, Westchester Co., NY, and was also buried in Chappaqua Cemetery, Chappaqua, Westchester Co., NY.[78] Her will was dated 19 Feb. 1812, and probated on 18 Jan. 1813, and she mentioned only her daughter Philinah Tompkins, and sons William Worshbourn, Samuel Worshbourn, and Jesse Worshbourn, and she named her sons William and Samuel Worshbourn as executors of her estate.[79] (See Appendix [E] for a full transcription of her will.)

         Richard Washburn and Amy Birdsall had children:

+      2266     i   Philena6 Washburn, born on 16 Aug. 1749 in North Castle, Westchester Co., NY,[80] mentioned in the 1775 will of her father, and called “Philinah” Tompkins in her mother’s 1812 will, mar­ried Richard Tompkins, son of Nathaniel and Mary (Forshay) Tompkins,[81] in ca. 1771.[82] (To be continued in Washburn Generation 6.)

+      2267    ii   Joseph6 Washburn, born on 29 May 1752 in North Castle, Westchester Co.,[83] mentioned the 1775 will of his father, married Freelove Matthews, daughter of Ananias and Mary (Mearns) Matthews,[84] on 1 Feb. 1775.[85] (To be continued in Washburn Generation 6.)

+      2268   iii   Daniel6 Washburn, born on 13 Nov. 1754 in North Castle, Westchester Co., NY,[86] mentioned in the 1775 will of his father, mar­ried Phylena Matthews, daughter of Ananias and Mary (Mearns) Matthews,[87] and sister of Freelove Matthews.[88] (To be continued in Washburn Generation 6.)

+      2269   iv   William6 Washburn, born on 13 Dec. 1756 in North Castle, Westchester Co., NY,[89] mentioned in both the 1775 will of his father and the 1812 will of his mother, was cap­tured by the Brit­ish during the Revolutionary War, but escaped, and married Lydia Lane.[90] (To be continued in Washburn Generation 6.)

        2271   vi   Amy6 Washburn, born on 3 July 1761 in North Castle, Westchester Co., NY,[94] mentioned in the 1775 will of her father, but not in the 1812 will of her mother, never mar­ried, died on 5 Sept. 1825,[95] but no probate records were filed for her estate in Westchester Co., NY.

+      2272  vii   Samuel6 Washburn, born on 20 July 1763 in North Castle, Westchester Co., NY,[96] mentioned in both the 1775 will of his father and the 1812 will of his mother, mar­ried 1.)         2274   ix   Richard6 Washburn (Jr.), born on 10 May 1769 in North Castle, Westchester Co., NY,[100] mentioned in the 1775 will of his father, probably married Mary “Polly” (__) in ca. 1791.[101] He may have been the Richard Washburn living in Greenburgh, Westchester Co., NY, in the 1800 federal census.[102] On 5 May 1807 Richard Washbourn, of Greensburgh, Westchester Co., NY, farmer, and Mary his wife, sold to John Martine, of Greensburgh, farmer, for $1062.50, two tracts of land in Greensburgh containing in total about 25 acres, including timber rights in a parcel of land that Richard Washbourn had formerly sold to James Tompkins in Greensburgh.[103] He died after 1807, but no probate records were filed for his estate in Westchester Co., NY.

 

 

(859.) Silas5 Washburn, possibly youngest son of (276) John4 Washburn (3rd), (89) John3 (Jr.), (49) John2, (30) William1; born supposedly in Westchester Co., NY, in ca. 1733,[104] married Mary Car­penter, daughter of Robert and Mary Carpenter,[105] of North Castle, Westchester Co., NY, in ca. 1762.[106] She was a granddaughter of Nathaniel and Tamar (Coles) Carpenter.[107] The will of Robert Carpenter, of North Castle, dated 25 Feb. 1750/51, and probated on 7 Mar. 1751/51, mentioned his wife Mary, and daughter Mary Carpenter, among others.[108] (See Appendix [F] for a full transcription of the will of Robert Carpenter.) Silas Washburn served in the Revolutionary War in Col. Hammond’s Company, in 1779-1780.[109]

         Silas Washburn died testate in ca. 1786 in North Castle, Westchester Co., NY. His will was dated 18 July 1785, and presented for probate on 6 Sept. 1786, and he mentioned his wife Mary, sons Bethuel and Caleb, daughters Phebe and Elizabeth, sons Silas and Darias, daughters Mary and Hannah, son Robert, daughter Freelove, daughter Deborah, and son Jacob. His will was witnessed by Joseph Worshburn, John Greene, and Jacob Carpenter, and he named his wife Mary and son Bethuel as co-executors of his estate.[110] (See Appendix [G] for a full transcription of his will.)

         Silas Washburn and Mary Carpenter had chil­dren, order uncertain, but presumably named in birth order in the will of their father:[111]

        2275     i   Bethuel6 Washburn, presumably the eldest son, born in ca. July 1763,[112] co-executor of his father’s will, married Elizabeth (___),[113] who was born on ca. 3 Apr. 1762.[114] He was not listed as a head of household in Westchester Co., NY, in the 1800 federal census, but he was living in Cortlandt, Westchester Co., NY, in the 1810,[115] and 1820 federal censuses, where he was a farmer,[116] and he was probably the Matthewal Washburn living in Cortlandt Co., NY, in the 1830 federal census.[117] He died testate on 19 Feb. 1835 in Cortlandt, Westchester Co., NY, aged 71 years, 7 months,[118] naming his wife Elizabeth Warshburn as executrix of his estate, and mentioned, in addition to his wife Elizabeth, his daughter Eliza Ann Worshburn.[119] (See Appendix [H] for a full transcription of his will.) On 17 Oct. 1835 Elizabeth Washburn, of Cortlandt, Westchester Co., NY, executrix of the last Will and Testament of Bethuel Washburn, deceased, sold a tract of land in Cortlandt, Westchester Co., NY, containing 30 acres and 12 rods to Thomas B. Roe, of Cortlandt, for $1710.[120] She died a widow on 29 Oct. 1845 in Peekskill, NY, aged 83 years, 6 months, 26 days.[121] They had one daughter:

a. Eliza7 Ann Washburn, born ca. 1797,[122] mentioned in the 1835 will of her father, married Thomas B. Roe, of Kings Co., NY, before 1835,[123] and they settled in Cortlandt, Westchester Co., NY. He was born ca. 1796 in NY.[124] They were living in Cortlandt, Westchester Co., NY, in the 1850 federal census, where he was a farmer.[125] She died on 14 Feb. 1853 in Cortlandt, NY, aged 55 years, and was buried in Hillside Cemetery, Cortlandt Manor, Westchester Co., NY.[126] He died intestate on 26 Oct. 1865 in Peekskill, Westchester Co., NY, aged 69 years, and was buried in Flushing, NY.[127] His son, Sanford W. Roe, was granted administration of his estate on 15 Nov. 1865.[128]

+      2276    ii   Caleb6 Washburn, born say ca. 1764, mentioned in the 1785 will of his father, married Rachael (___), and they lived in Columbia Co., NY. (To be continued in Washburn Generation 6.)

+      2277   iii   Phebe6 Washburn, born say ca. 1765 in NY,[129] mentioned in the 1785 will of his father, married William Ogden, son of Joseph and Mary (Terry) Ogden,[130] on 5 Mar. 1788.[131] (To be continued in Washburn Generation 6.)

        2278   iv   Elizabeth6 Washburn, born supposedly on 8 Feb. 1767 in NY,[132] mentioned in the 1785 will of his father, possibly married (___) Sarles.[133] Children not found. She supposedly died on 17 Aug. 1816 in Dutchess Co., NY.[134]

I Joseph Moore of Newtown in Queens County on Nassau Island in the Colony of New York in America Esqr being at this time Indisposed in Body but of sound and perfect mind memory Judgment and understanding for which I desire to praise the Lord and Calling to mind the Mortality of my Body it being appointed for all Men once to Die Do make this my last Will and Testament in manner and form following (that is to say) Principally and first of all I give and Recommend my precious and immortal soul into the hands of God that gave it hoping through the merits passion Death and Resurrection                 In the name of Good Amen the twenty ninth day of July in the year of our Lord One thousand seven hundred and Eighty eight I Joseph Worshburn of North Castle in the County of Westchester and State of New York being very weak in body but of perfect mind and memory thanks be given unto God therefore calling unto mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last Will and Testament that is to say principally and first of all I give and recommend my Soul into the hands of God that gave it, and for my body I recommend it to the Earth to be buried in a Christian like and decent manner at the discression of my Executors nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God and as touching such worldly Estate wherewith it hath pleased God to bless me with in this life I give demise and dispose of the same in the following manner and form.

Imprimis I give and bequeath Unto Roseanah Worshburn my dearly beloved Wife all my household goods for her life as long as she remains my widdo likewise it is my Will that my wife shall have the Use of my farm till my son Joseph comes of perfect age then it is my Will that my dear Wife shall have the Use of one third part of the farm for her maintenance during her Widdo hood in conjunction with my two Sons

Item I give to my well beloved son James Worshburn the one equal half of my lands lying in North Castle forever at the decease of my wife or before if the Executors finds it necessary. Item I give to my well beloved son Joseph Washburn all the one equal half of my lands lying in North Castle when he shall arrive at the age of twenty one forever then it is my Will that they may divide or dispose of as they think propper with advice of their mother. Item my Will is that after the decease of my wife that all my personal Estate and house hold goods be equally divided between my daughters that is to say my daughter Hannah and my daughter Phebe and my daughter Anna and my daughter Susanah and my daughter Deborah and my daughter Mercy and my daughter Sarah. It is my Will that my dearly beloved wife Roseanah Worshburn and my well beloved son James Worshburn and my well beloved Joseph Worshburn shall be and I likewise constitute make and ordain my only and sole Executors of this my last Will and Testament and I do hereby utterly disallow revoke disannul all and every other former Testaments Wills Legacies and Executors by me in any ways before this time Named Willed and bequeathed rattifying and confirming this and no other to be my last Will and Testament.                                                                                                                 First I do recommend my Soul into the hands of God that gave it & my Body to be buried in a Christian like & decent manner at the discretion of my Executors hereafter named & as to Worldly Estate that it has pleased God to bless me with, I will & bequeath as followeth Vizt.

                                                                                                                First my Will is that all my Just debts be first paid & discharged by my Executors hereafter named in the manner I shall hereinafter direct, & in the next place my Will is & I do order that my well beloved wife Hannah Shall have the use of my Houses & Orchard with a hundred Acres of Land Joyning to the Same So as it is or may be Convenient for her Lying between Feeksis Lane & the Highway that Leads through Buckram & to Extend Eastwardly to the Brook near William Carpenters & one half of all my Meadow & six Cows such as she shall chuse out of my Stock & two of my best horses & all my Sheep & Hogs & all my Household Goods after my Daughter Amy has had as much out of it as to be Equal with my Daughter Jehannah During her Life for her support and to enable her to bring up her children, & the moveable Estate that she doth not make use of she may Give to which of her Children she pleases at or before her Death And my will further is & I do hereby empower my Executors hereafter Named or the Major part of them to Sell all the remaining part of my Stock that is not disposed of & all my Lands lying Northward of the lane Called Feeksis Lane & to pay my Debts out of it & the remainder if then be any I Give to my Said Wife And my Will further is And I do hereby Will give and bequeath unto my five Sons Vizt. William Hawkxhurst Samson Hawkxhurst Joseph Hawkxhurst Benjamin Hawkxhurst & Daniel Hawkxhurst and to their heirs & Assigns forever All my Lands & meadows Excepting what is to be sold to pay my Debts of what Nature Soever to be Equally divided between them only I order that my two Youngest Sons Benjamin & Daniel shall have that hundred acres which I have given my wife the profit of for her Life to be Equally Divided between them in part of their portions & to have as much more Land & Meadow as to make their parts of Equall Vallue with their Three Elder Brothers parts & if Any or either of my Said Sons Shall dye before they come to the Age of twenty one Years or have issue then their part or parts Shall be Equally divided between the Surviving Brothers, And if my Daughter Amy Shall not be Married before her Mothers Death my Will is that She shall have the use of my New house Chamber untill she Shall marry & my will is further that my Said Sons William & Samson Shall pay each of them to their Sister Jehannah the wife of Daniel Burdsell the Sum of thirty shillings out of that part of my Estate which I Gave them within one Year after they enter upon the same & my will is further that my three Youngest Sons Joseph Benjamin & Daniel Shall Each of them pay to their sisters three Children Sarah Burdsell Mary Hannah Burdsell & Amy Burdsell the sum of One pound ten shillings out of their parts of the Estate which I Gave them within one Year after they enter upon the same to be Equally divided between them to buy Each of them A bible  My Will is further that My Beloved Wife Hannah And my Cousin Zebulon Dickenson & my Cousin Samson Crooker And my Cousin Jarvis Mudge & my Brother Micajah Townsend shall be the Executors of this My Last will & testament  And I do hereby utterly dissallow revoke make null & void all former wills & bequeaths by me at any time heretofore made, And I do hereby allow this & no other to be my Last will & Testament  In Witness whereof I have hereunto Set my hand & fixed to my Seal this twenty third day of October in the sixth Year of the reign of our Sovereign Lord George the Second by the grace of God King of Great Brittain &c Annoq Domini One thousand Seven hundred & thirty two

In the Name of God amen I Richard Warsbourn of North Castle being in good health and sound in mind and memory in the County of Westchester and Province of NewYork yeoman Do make and ordain this my last Will and testament in manner and form following. First it is my Will and desire that all my just debts and funeral Charges be Paid. Secondly Item I bequeath unto my loving wife Amy Worsbourn a bed and furniture, a horse and saddle a looking glass and houshold furniture sufficient to keep house likewise the best room in my house to dwell during her continuing my Widow together with one hundred Pounds in cash after the sale of the estate to be Paid unto her. Item I bequeath unto my son Joseph one hundred and fifty Pounds. Item I bequeath unto my son Daniel one hundred and fifty Pounds N.B. all NewYork Currancy. Item I bequeath unto my son William Worsbourn all my Blacksmith tools and a horse and saddle and fifty Pounds in money N.B. my son Daniel according to my Will to have a suficiency of farming uttentials equal to his eldest brother. Item I give and bequeath unto my son John one hundred and fifty Pound of the currency aforesaid. The Inventory of the goods, chattles and credit of Amey Worshbourn, widow, late of New Castle, taken by William Worshbourn, Samuel Worshbourn, John Worshbourn and Benjamin Kipp on 9 Dec. 1812, not totaled, but included two notes of hand of $125.00, and $86.00, and $104.30 in money on hand, no real estate.

In the Name of God Amen, the twenty fifth day of February in the year of our Lord, one thousand seven hundred and fifty or fifty one  I Robert Carpenter of North Castle in the County of Westchester, in the province of New York Yeoman being very sick and weak in Body but of perfect mind and memory thanks be given unto God therefore calling unto mind the Mortality of my Body and knowing that it is appointed for all Men once to die do make and ordain this my last will and Testament that is to say principally and first of all I give and Recommend my Soul into the hands of God that gave it and for my Body I recommend it to the Earth to be buried in a Christian like and decent manner at the discretion of my Executors Nothing doubting but at the General Resurrection I shall receive the same again by the mighty power of God and as touching such Worldly Estate wherewith it hath pleased God to bless me in this life I give devise and dispose of the same in the following manner and form  Imprimis it is my will and I do order that in the first place all my just debts and funeral Charges be paid  Item I give and bequeath unto Mary my dearly beloved Wife Twenty pounds a year to be paid her yearly out of my Estate as long as she continues my widow and all the whole use of my dwelling house and one third part of the Orchard whereon I now live during her widowhood as first said and my will is that my Estate keep her a horse and a cow during the whole time of her being my widow and my will is yt if my wife marrys that she shall carry and have all the goods and chattels that she brought with her for her own proper Estate forever and likewise my will is yt she shall receive them into her hands and Cear immediately after my death  Item I give to my well beloved son Jacob Carpenter five pounds Current Money of New York to be paid out of my Estate before devision – Item I give to my well beloved daughter Mary Carpenter one feather Bed viz. with a striped Cotton tick and a Bollster and two pillows and two Blanketts and a Green Rugg and Six Silver Tea Spoons and a Silver Tumbler all out of my Estate before division  Item I order and my will is yt as soon as my widdow marreys or moves of from the aforesaid house and Orchard that all my farm Lands houses and Mill be sold at Publick Vendue and all the Moneys so sold for to be equally divided between all my Children Viz: Jacob Carpenter, Zopher Carpenter, Zenos Carpenter Bezzillia Carpenter Bethuel Carpenter Jarias Carpenter Ruphas Carpenter and my Daughter Mary Carpenter that is to say they shall every one of them have an Eaqual share as they come to the age of twenty one years – Item My will is and I do order all my moveable Estate to be sold within Ten Days after my Burial at publick Vendue and all ye Money or Sums of Money that my said Estate or moveables is So sold for be Eaqually devided amongst all my Children when they come to age as abovesaid but if either of them dye before they arrive to age as abovesaid then the whole estate to be devided among all the rest of my Children yt is alive at yt time – Item my will is and I do order my Estate to bring up my two youngest Children Viz: Ruphas and Mary untill such time as they are fit to be put to trades – Item – I constitute make and ordain my well beloved Wife and my two Sons Viz: Jacob Carpenter and Zopher My Executors to this my last Will and Testament and I do hereby utterly disalow & revoke and disannul all all and every other former testaments Wills Legacies and Executors by me in any ways before named willed and bequeathed ratifying and confirming this and no other to be my last Will and testament . . . .

        In the Name of God Amen, I Bethuel Warshburn at present of Cortlandt Town in the County of Westchester and State of New York, Yeoman, being of Sound disposing mind memory and Understanding but considering the uncertainty of this mortal life do make and publish this my last Will and Testament in manner and form following — First and principally I commend my Soul to the Almighty God who gave it and my Body I Comit to the Earth to be deciently interred at the Discretion of my Executrix herein after named and as to such worldly Estate as God of his Goodness hath been pleased to bestow upon me I give and dispose of in manner herein after mentioned —

        Imprimis I will and direct that all my just debts and Funeral charges be paid and Satisfied by my said Executrix.  Itim, it is my Will and desire that all my Estate both real and Personal of what nature or kind soever the same may be – Shall be Sold by my Said Executrix as soon as conveniently may be after my decease and turned into money which money togeather with any money that I may leave at the time of my decease (Comprehending all Outstanding Debts) after paying my debts and Funeral Expences shall be disposed of in manner following that is to say First. I give and bequeath unto my Wife Elizabeth Worshburn all money that shall remain after Paying all my just Debts & Funeral Expences so long as she remains my Widow That then the same go to my Daughter Eliza Ann Worshburn and to her Heirs and Assigns forever and I do hereby nominate and and appoint my Wife Elizabeth Washburn Executrix of this my last Will and Testament — hereby revoking all former and other Wills and Testaments by me at any Time heretofore made –

Elizabeth Warshburn, the Executrix, petitioned for probate of the Will of Bethuel Worshburn on 11 Apr. 1835, and testified that Bethuel Warshburn died on 19 Feb. 1835 in the Town of Cortlandt. Seamans Jacobs testified on 9 June 1835 that he served notice to Thomas Roe and Eliza Ann Roe, his wife, of Kings County, more than 20 days prior to 9 May 1835. The will was proved by Seamans Jacobs on 9 May 1835, who also testified that Samuel Jones, one of the witnesses, had died in about 1826.

 

Letters of Administration were granted to Elizabeth Warshburn, the Executrix, on 13 May 1835.
